It is not necessary now to determine the exact scope of the Religious Preference clause of the Constitution Section 3 of Article 1 is binding alike on the Legislature and the school authorities. So far we are clear that the Legislature has not crossed these constitutional limitations. The Tennessee Supreme Court's decision held in effect that the Butler Act was constitutional under the state Constitution's Religious Preference Clause, because the Act did not establish one religion as the "State religion".
